AI Works – Terms & Conditions

1. Acceptance of Terms

By creating an account, joining a waitlist, subscribing to a plan, or otherwise using AI Works, you confirm that you:

• Have read and understood these Terms;
• Are at least 18 years old, or have legal parental/guardian consent if younger;
• Have the authority to agree to these Terms on behalf of yourself or your organisation.

2. Use of Services

You agree to use AI Works responsibly and lawfully. You must not:

• Misuse or attempt to hack, overload, or disrupt our systems;
• Use AI Works for illegal, harmful, defamatory, or discriminatory purposes;
• Generate or distribute content that infringes intellectual property rights;
• Misrepresent AI Works outputs as legal, financial, or medical advice without professional oversight;
• Attempt to reverse-engineer or resell our technology without permission.

⚠️ Fair Use: AI Works may introduce usage limits to protect service stability. Excessive or abusive use may result in suspension.

3. Accounts, Waitlists & Subscriptions

• Waitlist signups are non-binding but allow us to contact you about launch updates.
• Subscriptions are billed monthly or annually; renewal is automatic unless cancelled.
• Account details must be accurate; you are responsible for keeping login credentials secure.
• AI Works may suspend or terminate accounts that breach these Terms.

4. Data Protection & Privacy

• AI Works complies with South Africa’s POPIA and GDPR for international users.
• Personal data (e.g., name, email, waitlist info) is collected only for service delivery, not resale.
• By using AI Works, you consent to our Privacy Policy and Cookie Policy.

5. Intellectual Property

• All content, branding, software, and assistants are the property of AI Works and protected by copyright, trademark, and IP laws.
• You retain ownership of your inputs and outputs but grant AI Works a licence to process them to provide the Services.
• AI Works may use anonymised, aggregated data to improve models and services.

6. Disclaimers & Limitations of Liability

• No Guarantees: AI Works provides information and guidance but does not replace professional advice (legal, financial, medical, or otherwise).
• Use at Own Risk: You acknowledge that GPT outputs may contain inaccuracies.
• No Liability: AI Works is not responsible for indirect, incidental, or consequential damages arising from your use of the Services.
• Maximum liability is limited to the fees paid by you in the preceding 3 months.

7. Third-Party Tools & Integrations

Some AI Works features may integrate with third-party plugins or services. AI Works is not responsible for their content, security, or reliability.

8. Service Availability

AI Works strives for uninterrupted service but does not guarantee 100% uptime. Planned maintenance, technical issues, or external factors (e.g., hosting outages on Xneelo) may cause downtime.

9. Termination

AI Works may suspend or terminate your access if you breach these Terms or misuse the Services. You may cancel your subscription at any time via your account settings.

10. Changes to Terms

AI Works may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of South Africa. Any disputes shall be resolved under the jurisdiction of South African courts.
